This Privacy Policy explains how Simply 360 collects, holds, uses and discloses personal information in connection with our website, enquiries, quotations, photography and video services, virtual tours, Google Street View services, hosting, marketing consultancy, client projects and related business activities.

Simply 360 is operated by Pink Caviar Projects Pty Ltd trading as Simply 360.

In this Privacy Policy:

  • “Simply 360”, “we”, “us” and “our” refer to Pink Caviar Projects Pty Ltd trading as Simply 360;
  • “client” or “customer” refers to a person, business, organisation, government body or other entity that engages us to provide services; and
  • “you” refers to website visitors, clients, prospective clients, people appearing in project imagery and other people who interact with us.

1. Our approach to privacy

We are committed to handling personal information responsibly, transparently and securely.

Depending on the nature of our activities, some obligations under the Privacy Act 1988 (Cth) may not apply to our business. Where the Privacy Act applies, we will comply with it and the Australian Privacy Principles.

Where an exemption applies, we nevertheless aim to manage personal information in a manner generally consistent with accepted Australian privacy practices.

Nothing in this Privacy Policy limits any rights or obligations arising under applicable law.

2. What personal information we collect

The personal information we collect will depend on how you interact with Simply 360 and the services we are providing.

We may collect personal information including:

  • full name;
  • email address;
  • telephone number;
  • business or organisation name;
  • job title or position;
  • postal, billing or business address;
  • project and shoot location details;
  • enquiry, consultation and quotation information;
  • project requirements, briefs and specifications;
  • correspondence and communication history;
  • payment and transaction information;
  • invoice, receipt and accounting information;
  • information contained in files, documents, spreadsheets or other material supplied for a project;
  • client logos, branding, text, photographs, videos and other project assets;
  • names, photographs, video or other information relating to people included in project content;
  • property, facility, venue or business information included in a virtual tour or photographic project;
  • website comments, enquiries or other content you submit;
  • marketing and communication preferences;
  • IP address, browser and device information;
  • general geographic or location information associated with website use;
  • website usage, analytics and cookie information; and
  • photographs, video, audio and other visual content captured or created while providing our services.

Where relevant to a project, imagery may incidentally contain identifiable individuals, vehicles, number plates, signage, business information or other details visible at the location being photographed.

2.1 Sensitive information

Simply 360 does not generally need to collect sensitive information as part of its ordinary services.

However, sensitive information may occasionally be included in information or imagery provided to us by a client or captured at a project location.

Where we intentionally collect sensitive information, we will only do so where reasonably necessary for our functions or activities and with consent where required by law, unless another legal exception applies.

Clients should avoid providing sensitive information unless it is reasonably necessary for the project.

2.2 Anonymous or pseudonymous interactions

Where lawful and practical, you may interact with us anonymously or using a pseudonym.

However, we generally need to identify clients and prospective clients when preparing quotations, entering into contracts, arranging site access, processing payments or delivering project services.

3. How we collect personal information

We may collect personal information when you:

  • visit or interact with the Simply 360 website;
  • complete a contact or quotation form;
  • book a consultation;
  • contact us by email, telephone, website form or social media;
  • request or accept a quotation;
  • engage us to provide a service;
  • provide project specifications, files, branding or other content;
  • participate in a photography, video or virtual-tour project;
  • provide feedback or request project changes;
  • comment on website content;
  • subscribe to marketing communications; or
  • interact with our emails, advertisements, social media or digital content.

We may also collect personal information from:

  • our clients and their staff;
  • project managers, marketing teams and agencies;
  • property owners, managers or occupiers;
  • venues, schools, businesses and organisations;
  • suppliers and contractors;
  • publicly available business and professional sources;
  • social media and professional networking platforms;
  • payment providers;
  • website, analytics and technology providers; and
  • other people involved in arranging or delivering a project.

If you provide personal information about another person, you must have authority to provide it and should make that person aware of this Privacy Policy where appropriate.

4. Why we collect and use personal information

We collect, hold, use and disclose personal information for purposes including:

  • responding to enquiries;
  • preparing quotations and proposals;
  • booking consultations and photography sessions;
  • planning and managing client projects;
  • arranging access to project locations;
  • providing 360 virtual tours;
  • providing Google Street View photography;
  • providing 360-degree photography and video;
  • providing aerial and drone photography where applicable;
  • providing conventional photography and related visual services;
  • preparing floorplans and other project deliverables;
  • providing virtual reality and interactive experiences;
  • providing marketing consultancy and related services;
  • building, editing, hosting and maintaining virtual tours;
  • communicating with clients about project progress, reviews and changes;
  • uploading or publishing content where required by the service;
  • processing payments, invoices and refunds;
  • maintaining business, accounting and contractual records;
  • responding to support requests, concerns and complaints;
  • sending marketing communications where permitted by law;
  • managing client and supplier relationships;
  • improving our website, services and customer experience;
  • conducting analytics, reporting, advertising and remarketing;
  • preventing fraud, misuse and security threats;
  • protecting our rights, equipment, systems and intellectual property; and
  • complying with legal, accounting, insurance, tax, regulatory and record-keeping obligations.

If you do not provide information reasonably required for an enquiry, quotation or project, we may not be able to provide the requested service.

5. Photography, video and identifiable imagery

Simply 360 provides photography, video and virtual-tour services that may capture identifiable individuals or other identifying information.

Before a photography or video session, clients are responsible for:

  • arranging appropriate access to the location;
  • notifying people who may be intentionally photographed or recorded;
  • obtaining any consent or permissions reasonably required from employees, customers, students, visitors, actors or other individuals appearing in the project;
  • ensuring they have authority to request photography or recording at the location; and
  • advising Simply 360 of any areas, people, information or items that should not be captured.

Simply 360 will take reasonable steps to follow agreed project instructions and privacy requirements.

For custom virtual-tour projects, our standard editing process may include blurring identifiable faces and vehicle number plates where appropriate.

If a client requests that an identifiable person’s face not be blurred, the client is responsible for ensuring that appropriate consent or authority has been obtained.

Where reasonably practicable, please notify us before publication if particular identifying information needs to be removed, blurred or otherwise modified.

6. Google Street View and third-party publishing platforms

Some Simply 360 services involve uploading or publishing imagery through third-party platforms, including Google Maps, Google Business Profile, Google Street View, YouTube or other platforms requested or approved by a client.

Where content is published through a third-party service:

  • that platform may independently collect and process information;
  • the platform’s own privacy policy, terms and technical requirements may apply;
  • Simply 360 may have limited control over the platform once content has been uploaded; and
  • removal, modification or processing of imagery may be subject to the platform’s rules and functionality.

Google Street View imagery is edited and published in accordance with applicable Google requirements. These requirements may include automated or required blurring of faces and number plates.

Where Simply 360 uploads content to a client-controlled Google Business Profile, YouTube account or other third-party account, the client is also responsible for its use and management of that account and the published content.

7. Client-provided information and content

Clients may provide Simply 360 with information and digital assets required to create a project, including:

  • logos;
  • text;
  • photographs;
  • videos;
  • audio;
  • floorplans;
  • links;
  • contact information;
  • staff information;
  • hotspot content; and
  • other business or marketing material.

Clients are responsible for ensuring that they have authority to provide this information and content to us and that its use for the project does not unlawfully infringe the privacy, confidentiality or other rights of another person.

We use client-provided information for the purposes of delivering the relevant project and related services.

Where information is confidential or subject to particular restrictions, clients should notify us before providing it.

8. Portfolio, case studies and promotional use

Subject to our agreement with the client, applicable law and any agreed confidentiality requirements, Simply 360 may use completed project imagery, virtual tours or other project content for purposes including:

  • our website and portfolio;
  • case studies;
  • social media;
  • presentations and showreels;
  • sales and capability materials;
  • printed promotional material;
  • award submissions;
  • media and public relations; and
  • marketing and promotion of Simply 360 services.

Any use of personal information or identifiable imagery remains subject to applicable privacy requirements.

Where additional consent is appropriate for an individual testimonial, interview, endorsement, featured portrait or similar promotional content, we may request that consent separately.

9. Payment information

Simply 360 may use third-party payment, accounting or financial service providers to process payments.

We may receive or hold:

  • payment confirmation;
  • transaction information;
  • billing details;
  • payment status;
  • invoice information;
  • refund records; and
  • related accounting information.

We do not collect or store complete payment-card details on our own systems where payment cards are processed through an external payment provider.

Payment providers may collect information directly from you and handle it in accordance with their own privacy and security practices.

10. Marketing communications

We may send you marketing communications about Simply 360 services, projects, industry content, offers, news and related opportunities where:

  • you have consented to receive them; or
  • we are otherwise permitted to do so by law.

We generally request marketing consent through a separate and optional selection during an enquiry, consultation, booking or subscription process.

Submitting a contact form, requesting a quotation, engaging Simply 360 or providing us with your business contact information does not automatically subscribe you to all future marketing communications.

Our commercial electronic messages will identify Simply 360 or Pink Caviar Projects Pty Ltd as the sender, provide valid contact information and include a straightforward means of unsubscribing where required by law.

You may unsubscribe at any time by:

  • using the unsubscribe facility included in the communication; or
  • contacting us at info@simply360.com.au.

We will action unsubscribe requests within five working days or within any other period required by law.

We may retain limited contact information on a suppression list so that an unsubscribe request continues to be respected.

If you unsubscribe from marketing communications, we may still send non-marketing communications reasonably necessary to:

  • respond to an enquiry;
  • provide a quotation;
  • administer a current project or agreement;
  • issue invoices or payment information;
  • arrange a photography session;
  • provide project updates or deliverables; or
  • otherwise provide a service you have requested.

Consent to receive Simply 360 marketing does not automatically constitute consent to receive independent marketing from Pink Caviar Events, Event RSVP, Future of Events Summit or another trading name of Pink Caviar Projects Pty Ltd unless the relevant consent request expressly identifies those brands.

11. Cookies, analytics and online tracking

The Simply 360 website uses cookies and similar technologies.

These may include cookies, pixels, tags, web beacons and local storage used to:

  • operate and secure the website;
  • remember preferences;
  • understand website usage;
  • measure enquiries and marketing performance;
  • improve our website and services;
  • personalise content;
  • create advertising audiences; and
  • support advertising and remarketing.

We may use technology supplied by third-party providers such as analytics, advertising, social media and website service providers.

When you first visit our website, you may be provided with controls to accept, decline or manage non-essential cookies.

You can also adjust your browser settings to block or delete cookies. Some website features may not function properly if cookies are disabled.

12. Who we may disclose personal information to

We may disclose personal information where reasonably necessary to:

  • our staff and contractors;
  • clients and people involved in the relevant project;
  • photographers, videographers, drone operators and production suppliers;
  • web developers and virtual-tour technology providers;
  • website hosting, cloud storage, cybersecurity and IT providers;
  • payment processors and financial service providers;
  • accounting and invoicing providers;
  • email marketing, CRM and communication providers;
  • analytics, advertising and social media platforms;
  • Google and other publishing or hosting platforms where required for a project;
  • suppliers and professional advisers;
  • insurers, accountants and lawyers;
  • government, regulatory, law-enforcement or emergency authorities where required or permitted by law; and
  • a party involved in a proposed or completed sale, merger, restructure or transfer of all or part of our business, subject to appropriate legal and confidentiality requirements.

We limit disclosures to information reasonably required for the relevant purpose.

We do not sell or disclose personal information as a standalone product.

13. Overseas storage and disclosure

Some technology, cloud, website, email, analytics, payment, publishing and other service providers we use may store, access or process personal information outside Australia.

The location of overseas recipients will depend on the service providers used from time to time.

Where required by applicable law, we will take reasonable steps to ensure that any overseas disclosures of personal information are handled appropriately and in accordance with Australian privacy requirements.

14. Security of personal information

We take reasonable administrative, technical and physical steps to protect personal information from misuse, interference, loss, unauthorised access, modification and disclosure.

These steps may include:

  • secure technology systems;
  • encrypted website connections;
  • access controls and password protection;
  • multi-factor authentication where available;
  • restricting access to staff and suppliers who reasonably require the information;

Where required by applicable law, we will notify affected individuals and the Office of the Australian Information Commissioner of an eligible data breach.

We may also provide voluntary notification where we consider this appropriate to reduce the risk of harm.

Where a suspected breach involves information held or processed on behalf of a client, we may work with that client to investigate, contain and respond to the incident.

16. Data retention

We retain personal information for as long as reasonably necessary for:

  • responding to enquiries;
  • project planning and delivery;
  • providing hosting or ongoing support;
  • maintaining client and supplier relationships;
  • customer service and complaint handling;
  • accounting, taxation and insurance;
  • contractual and legal requirements;
  • fraud prevention and dispute resolution;
  • maintaining business and project records; and
  • marketing where consent remains current or marketing is otherwise permitted by law.

Project imagery and completed project files may be retained for longer periods where reasonably necessary for hosting, ongoing support, archival, licensing, portfolio, legal or contractual purposes.

Where information is no longer reasonably required, we will take reasonable steps to delete, destroy or de-identify it unless continued retention is required or permitted by law.

We may retain limited contact information on a suppression list to ensure that unsubscribe requests continue to be respected.

17. Access and correction

You may request access to personal information we hold about you or ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading.

We may need to verify your identity before providing access or making a correction.

Where information or imagery is held as part of a client project, we may need to consult with the relevant client before responding to your request.

In some circumstances, access or correction may be refused or limited where permitted by law. Where appropriate, we will explain the reason for the decision and available complaint options.

18. Privacy and marketing complaints

If you have a concern about how we have handled your personal information, imagery or marketing preferences, please contact us at info@simply360.com.au with:

  • your name and contact details;
  • the project, service or communication concerned;
  • details of your concern;
  • relevant dates or communications; and
  • the outcome you are seeking.

We will acknowledge and investigate your complaint and aim to provide a substantive response within 30 days.

If we require additional time, we will let you know.

If your concern relates to content created on behalf of a Simply 360 client, we may consult with that client as part of our investigation.

If you are not satisfied with our response and the Privacy Act applies, you may be able to complain to the Office of the Australian Information Commissioner.

Complaints relating to commercial electronic messages or unsubscribe requests may also be made to the Australian Communications and Media Authority.

19. Third-party websites, platforms and services

The Simply 360 website, virtual tours and project content may contain links to or integrate with third-party websites, platforms and services.

These may include:

  • Google Maps and Google Street View;
  • Google Business Profiles;
  • YouTube;
  • social media platforms;
  • client websites;
  • advertising and analytics platforms; and
  • other external websites or resources.

We are not responsible for the privacy, security or content practices of independent third-party websites or services.

You should review the privacy policy and terms of any third-party service you use.

20. Changes to this Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to our activities, services, technology, service providers or legal obligations.

The current version will be published on the Simply 360 website with the updated effective date.

An update to this Privacy Policy does not, by itself, authorise us to use personal information already collected for a materially different purpose.

Where required, we will seek additional consent or rely on another lawful basis before doing so.
